Included Licensing Agreement Starter Points

  • 1FAA Part 107 certification is required for all commercial aerial operations; the creative is solely responsible for maintaining current certification and complying with all applicable regulations
  • 2LAANC authorization or a waiver must be obtained and documented before any flight in controlled airspace; records should be retained per project and available upon request
  • 3Written permission from the property owner is required before capturing or delivering aerial imagery of private property across all verticals — real estate, events, commercial, and film
  • 4Commercial use of aerial imagery in advertising, broadcast, or paid media requires an explicit commercial license agreement; standard delivery does not include commercial rights by default
  • 5For event and wedding aerial coverage, the creative must confirm venue airspace restrictions and obtain event organizer approval before the shoot date
  • 6Film and documentary aerial footage is subject to the same usage rights terms as ground-level production work; sync and distribution rights must be negotiated separately
  • 7APCHR does not indemnify the creative for regulatory violations, restricted airspace incidents, or property damage arising from flight operations; the creative assumes full operational liability
  • 8Portfolio use of aerial deliverables is retained by the creative; for identifiable structures, persons, or branded events, written consent from the relevant party is recommended before public display
