By accessing or using the APCHR platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms apply to all users, including buyers, creatives, and visitors.
APCHR is an online marketplace and business operating system that connects buyers seeking photography, videography, and editing services with independent creative professionals. APCHR provides tools for discovery, booking, contract management, payment processing, file delivery, and licensing management. APCHR is not a party to any service agreement between buyers and creatives; it acts solely as a platform facilitator.
You must create an account to access most features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update that information as necessary. APCHR reserves the right to suspend or terminate accounts that violate these Terms.
Creatives are responsible for the accuracy of their profiles, portfolios, packages, and pricing. Portfolio images must represent the creative's own original work. Misrepresentation of work, credentials, or availability may result in account suspension. APCHR reserves the right to review and remove profiles that do not meet platform quality standards.
All bookings are subject to a platform service agreement generated at the time of booking. Payments are processed through APCHR's escrow system. Funds are held until the buyer confirms delivery or the dispute resolution period expires. APCHR charges a platform fee on completed transactions; the applicable fee is disclosed during onboarding and on your account dashboard. Payouts to creatives are processed within 2-7 business days after escrow release, depending on plan tier.
Cancellation and refund policies are set by individual creatives and displayed on their profiles before booking. Buyers agree to the creative's stated policy at the time of booking. If a creative cancels a confirmed booking, APCHR will issue a full refund to the buyer. APCHR's dispute resolution team handles contested cancellations on a case-by-case basis.
Creatives retain copyright ownership of all work produced through the Platform unless an explicit written transfer of copyright is agreed to in a separate contract. Bookings include a usage license as defined in the platform-generated contract. License type (Personal, Commercial, or Extended) is selected at booking. APCHR's Specialization licensing starter points are provided as reference frameworks only and do not constitute legal advice. Users are encouraged to consult a licensed attorney before finalizing any licensing agreement.
Users may not: (a) solicit or accept payments outside the Platform for bookings initiated through APCHR; (b) submit false or misleading reviews; (c) upload portfolio work that is not their own; (d) harass, threaten, or engage in discriminatory conduct toward other users; (e) use the Platform to distribute spam or malicious content; (f) circumvent APCHR's payment or escrow systems; or (g) violate any applicable law or regulation. Violations may result in immediate account termination.
APCHR provides a formal dispute resolution process for unresolved conflicts between buyers and creatives. Disputes must be opened within 14 days of the delivery date. APCHR's decision in a dispute is final and binding on both parties. APCHR is not liable for losses arising from disputes between users.
To the maximum extent permitted by applicable law, APCHR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. APCHR's total liability for any claim arising out of these Terms shall not exceed the total fees paid by you to APCHR in the twelve months preceding the claim.
APCHR reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before taking effect. Continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located in Travis County, Texas.
